Trade Terms and Conditions

1. Interpretation

In these Trade Terms and Conditions, the terms “you,” “yours,” and “purchaser” refer to the customer, while “company” and “seller” refer to Broadhurst 4×4 (Pty) Ltd.

2. Purpose

2.1. These Terms and Conditions relate to contracts for the fitting, repair, or replacement of various products and services, including but not limited to tyres, wheels, batteries, trailer axles, 4×4 components, lights, electrical items, auto care and detailing products, and other retail goods, as well as balancing and alignment services, and any other services requested by you on any vehicle(s).

2.2. You agree to allow the company to perform the necessary work and fit any parts deemed necessary by the company to complete the work satisfactorily. The company may perform all or part of the work directly or through appointed agents or subcontractors.

3. Payment and Credit Terms

3.1. All goods are payable at the time of sale unless the purchaser has an approved credit account. If the purchaser has an approved credit account, payment for goods is due within 30 days from the date of the invoice, unless otherwise agreed upon in writing.

3.2. If an invoice is not paid as per condition 3.1, interest shall be payable on overdue amounts at an annual rate of two and a half (2.5) percent compounded monthly. All other invoices, whether due for payment or not, become immediately due and payable.

3.3. We reserve the right to apply payments received from you to debts in the order of the oldest, including interest on overdue debts.

3.4. All goods remain the property of Broadhurst 4×4 (Pty) Ltd until fully paid for.

4. Refunds and Exchanges

4.1. Subject to your statutory rights, refunds for parts that have been used are not possible. Faulty items may be replaced, and the cost of the replacement will be refunded if confirmed by the manufacturer.

4.2. A surcharge of two and a half (2.5) percent will be deducted for all card refunds.

4.3. We reserve the right to refuse or limit returns and refunds without a valid receipt.

4.4. A 15% handling charge may be levied for returns of correctly supplied goods as per the invoice, depending on the condition of the return and at the discretion of management.

4.5. Goods may only be returned within 7 days, subject to our prior approval.

4.6. No refund or return is accepted for electrical goods and associated wiring correctly supplied as per the invoice/order.

4.7. Products cannot be returned or refunded if found to be misused, purposefully damaged, or used for a purpose other than intended.

4.8. Valid proof of purchase is required for all returns and refunds.

4.9. Manufacturer’s warranties apply to relevant products.

5. Risk

5.1. You agree to allow the company and its employees to drive your vehicle for check purposes or inspection.

5.2. The risk in goods supplied passes to the purchaser upon acceptance of delivery.

6. Manufacturer’s Warranty

6.1. The company will assign to you any applicable manufacturer’s warranty for the goods supplied, to the extent permitted by law.

6.2. All other warranties, whether express or implied, are excluded to the extent permitted by law.

7. Limitation of Liability

7.1. Except as stated in these conditions or otherwise agreed in writing, the company shall have no obligation, duty, or liability in contract, tort, or otherwise, for any consequential or indirect loss or damage suffered by you under or in connection with any contract for supplies or services.

7.2. You shall indemnify and hold the company harmless against any liability arising in connection with any contract for supplies or services and our performance of any contract.

7.3. The company is not liable for any advice given by the company or its employees regarding the suitability of goods for any purpose.

8. Your Obligations

8.1. You shall not alter, remove, or vary any numbers or distinguishing marks on any goods supplied or fitted by the company, carry out any modifications not expressly authorized by the company, or resell any modified goods.

8.2. You agree not to resell or supply any goods supplied by the company except on terms that incorporate conditions for the proper use of the goods, as issued by the company, the manufacturer, or our supplier.

9. Delivery

9.1. Delivery of goods shall take place at the address specified by the seller on the date specified by the seller, unless otherwise agreed in writing.

9.2. The delivery date specified is an estimate, and time for delivery is not essential to the contract.

9.3. If you are unable to collect goods within 24 hours after being notified that they are available for collection or delivery, the company may place the goods in storage at your expense.

9.4. Goods left for repairs and not collected within 7 working days may be sold to defray costs, and no refund or credit note will be issued.

10. General

10.1. Tyre repairs, fitment, wheel balancing, and wheel alignment repairs are warranted for 2 days from the date of the invoice.

10.2. Any old parts removed from the vehicle must be taken by the owner within 24 hours of collection. After this period, the company will dispose of the parts and will not be responsible for any liability or losses incurred.

10.3. None of these terms and conditions shall be deemed waived, and no breach or default excused unless authorized in writing.

10.4. If any part of these terms is deemed unlawful or unenforceable, that provision shall be deemed severable from these terms without affecting the validity and enforceability of the remaining provisions.

10.5. By accepting these terms, you acknowledge and agree to their terms and conditions.

Your Acceptance of These Terms

By using this Site and engaging in trade with Broadhurst 4×4 (Pty) Ltd, you signify your acceptance of these Trade Terms and Conditions.

Disclaimer Notice and Indemnity Agreement

Acceptance of Risk: Guests entering Broadhurst 4×4 premises do so at their own risk and accept all associated risks.

Limitation of Liability: Broadhurst 4×4, its associated entities and companies and their respective officers, employees, agents, and contractors, will not be liable for any theft, injury, loss, or damage of any kind, irrespective of whether it is due to our negligence or stems from other factors. All Guests waive any claims against Broadhurst 4×4 for such occurrences.

Indemnification: Guests indemnify Broadhurst 4×4 against any claims resulting from their use of our products or services, including but not limited to injury, loss, or damage suffered on our premises or due to our services, regardless of the cause.

Vehicle and Personal Belongings: Broadhurst 4×4 is not responsible for damage to vehicles or loss of personal items left in vehicles while on our premises.

Personal Injury: We are not liable for any personal injuries sustained by Guests while on our premises, regardless of the cause.

Force Majeure: Broadhurst 4×4 is not liable for service delays or failures caused by events beyond our control, such as natural disasters, wars, strikes, or utility failures.

Acknowledgement: This disclaimer is deemed accepted by all Guests upon entering Broadhurst 4×4 premises.
